Is Kratom Legal in Maine in 2024?

Yes, kratom is legal here in Maine, but unfortunately it’s legal simply by default. Maine has largely ignored the regulation of kratom. And not just the regulation of safe, third-party tested kratom like we sell at MIT45, but adulterated products as well. In states without specific statutes, it’s more difficult to police adulterated products masquerading as responsibly manufactured kratom. 

That said, it almost went the other way entirely. In 2017, the state government attempted to pass bill ME LD1546, which aimed to classify mitragynine, the primary alkaloid in kratom, as a Schedule W substance. This categorization would have made kratom illegal. However, due to an upswell of grassroots support–both in Maine and nationally–the bill was passed without including mitragynine in the Schedule W list.

With all due respect to Stephen King, the FDA is what really scares us. As committed as we are to bringing kratom’s potentially life-changing benefits to the world, we’re not prepared to get shut down by shipping kratom to some place where it’s illegal to do so.

Again, the continued legality of kratom in Maine is largely thanks to the efforts of lobbyists and active citizens who advocated against the bill’s original provisions, ensuring that kratom can still be bought and sold in the state. 

Maine Attorney General’s Office

Despite the fact that there are few specific laws that apply to kratom, it’s not like the state doesn’t collect any information on kratom. Working with the Margaret Chase Smith Policy Center and the University of Maine, the state’s Office of Attorney General has, on occasion, funded studies like this drug death report. The report listed kratom appearing as a cause of death in 14 cases in 2020 and 10 cases in 2019.
