Thankfully, because of public pressure and kratom advocacy groups like the American Kratom Association (AKA), the DEA withdrew their intention.
Although the DEA decided not to add kratom to its list of Schedule I controlled substances, this doesn’t mean that the battle is over. While kratom devotees and advocacy groups want to ensure that the plant remains legal, they also want it to be regulated to make sure that the product is safe. In 2023, Massachusetts lawmakers introduced House Bill 3762, a version of the Kratom Consumer Protection Act. The bill’s highlights include:
- Restricting sales of kratom to those under 21 years of age
- Kratom products must be labeled and include a recommended serving size and the name and full address of the manufacturer
- The sales of adulterated kratom products would be illegal
As of April 2024, the Massachusetts Senate concurred with House Bill 3762. It passed and has been sent to the Joint Committee on the Judiciary. Once the governor signs it into law, it’ll be good news for Massachusetts residents who can continue to purchase kratom and will be assured that the product has the proper regulations to keep it safe.
