There was an attempt to make kratom illegal in 2020, but the legislative action failed. There have been no successful attempts to ban kratom in Hawaii. 

That means that kratom is legal in Hawaii, but a statewide Kratom Consumer Protection Act was passed in 2023 and updated in 2024. Even though there are some limitations on the sale and marketing of kratom, the KCPA guarantees that kratom users are protected from attempts to ban the substance. 

Anyone 18 years of age or older in Hawaii can use, purchase, sell, or possess kratom in all of its forms, including loose-leaf varieties, powders, kratom gummies, and liquid shots. Kratom vendors and manufacturers have to follow some specific rules related to testing, labeling, and marketing their products.

What Happens Next for Kratom in Hawaii? 

Now that the Kratom Consumer Protection Act (KCPA) has passed, kratom should be protected from further regulation. However, just like they did in 2024, the legislature may amend the KCPA and make small changes. You should pay attention to trusted voices in the kratom space to know what’s going on in Hawaii.

Stable Legal Status in Hawaii

We predict that kratom will remain legal in Hawaii for the foreseeable future. The KCPA protects users’ access to this botanical substance. Attempts to ban it have failed and we don’t anticipate any new attempts in the future.

Vendor Regulation

The purpose of the KCPA is two-fold: ensure that kratom users have access to high-quality kratom and prevent unscrupulous kratom vendors from sketchy manufacturing or marketing practices. 

Here’s a section from the KCPA that explains what kratom vendors can’t sell:

  1.  A kratom product that is adulterated with a nonkratom substance.  For purposes of this paragraph, “adulterated with a nonkratom substance” means the kratom product is mixed or packed with a nonkratom substance and that substance affects the quality or strength of the kratom product to a degree as to render the kratom product injurious to a consumer;
  2.  A kratom product that is contaminated with a dangerous nonkratom substance.  For purposes of this paragraph, “contaminated with a dangerous nonkratom substance” means the kratom product contains a substance that is not safe for human consumption;
  3.  A kratom product containing a level of 7‑hydroxymitragynine in the alkaloid fraction that is greater than two per cent of the alkaloid composition of the product;
  4. A kratom product containing any synthetic alkaloid, including synthetic mitragynine, synthetic 7‑hydroxymitragynine, or any other synthetically derived compounds of the kratom plant; or
  5.  A kratom product containing any controlled substance listed in any of the schedules under chapter 329, unless the product is compounded by a licensed pharmacist with the controlled substance dispensed in accordance with a valid prescription.

What does this mean for you, as a kratom user? It’s actually pretty great: it means that kratom vendors have to appropriately label their products, can’t mix kratom with unsafe products, and have to be consistent in how they manufacture their kratom. 

Additionally, kratom vendors who sell products in Hawaii will need to follow rules related to labeling the alkaloid content of each product and the complete ingredients list. There may be a change in the future that requires Hawaii’s kratom vendors to label specific serving sizes. 

No Kratom for Minors

Almost every time a Kratom Consumer Protection Act is proposed in the US, it includes placing an age limit on buying and consuming kratom. In Hawaii, that age limit is 18 years old.
