Current Status of Kratom Laws in Pennsylvania

The great kratom debate in Pennsylvania began in 2019 with HR 460, a resolution that requested the US Food and Drug Administration (FDA) label kratom as a food product and implement protocols and guidelines around its use. After much debate and discussion, by November 2020, HR 460 had been removed from the table, and no action had been taken.
In June 2022, Pennsylvania lawmakers passed the Kratom Consumer Protection Act (KCPA), which made kratom legal within the state. However, unlike other states that have passed the KCPA, Pennsylvania’s version only places an age restriction on the sales of kratom. Kratom is available for purchase to anyone 18 years of age or older.

A typical employer requested drug tests only screen for illicit substances. Even if you live in a state where kratom has been banned, it’s still highly unlikely that an employer or prospective employer would screen for kratom, or more specifically, for the alkaloids that kratom contains.
