Is Kratom Legal in Florida?

The History of Kratom in Florida

In January 2014, Sarasota County, FL, passed an ordinance that made the sale and possession of kratom illegal. Other counties attempted to enact similar ordinances, but none of them passed.

Kratom advocacy groups in Florida, like the American Kratom Association, have been at the forefront of the battle to keep kratom available for those who enjoy its benefits. However, they want the product regulated to ensure that what’s available for purchase isn’t adulterated.

Florida has introduced several versions of the Kratom Consumers Protection Act (KCPA), yet most have been stalled in committee. House Bill 179 was signed into law and became effective on July 1, 2023. HB 179 makes selling any kratom product to anyone under the age of 21 a second-degree misdemeanor, punishable by a fine of up to $500 and the possibility of up to 60 days in jail.

In December 2023, Florida lawmakers introduced Senate Bill 842, an updated version of the Florida Kratom Consumers Protection Act. SB 842 adds new regulations to the sale and possession of kratom products, namely:

  • Kratom products must not contain adulterated substances
  • The level of 7-hydroxymitragynine cannot be higher than 2%
  • Kratom products cannot contain any synthetic alkaloids
  • Products must have a label that clearly states the recommended serving size along with a list of all ingredients

Governor DeSantis signed Senate Bill 842 into law, which will take effect on July 1, 2024. This is excellent news for kratom enthusiasts. This new law protects the sale of kratom and ensures that nothing can be added to the product, among other safeguards.
