Is Kratom Legal in Florida?

The Sunshine State is home to over 20 million residents and has approximately 120 million visitors annually. Whether you’re a longtime resident, a snowbird, or a first-time tourist, Florida can provide you with sunshine, beaches, nightlife, and many other things. But what about kratom? Is kratom legal in Florida?

Each state has different laws regarding kratom. A few have banned it altogether, some have enacted regulations, while others have left it entirely unregulated. So, is kratom legal in Florida? The answer is yes, but kratom has had a rocky history in the Sunshine State.

The History of Kratom in Florida

In January 2014, Sarasota County, FL, passed an ordinance that made the sale and possession of kratom illegal. Other counties attempted to enact similar ordinances, but none of them passed.

Kratom advocacy groups in Florida, like the American Kratom Association, have been at the forefront of the battle to keep kratom available for those who enjoy its benefits. However, they want the product regulated to ensure that what’s available for purchase isn’t adulterated.

Florida has introduced several versions of the Kratom Consumers Protection Act (KCPA), yet most have been stalled in committee. House Bill 179 was signed into law and became effective on July 1, 2023. HB 179 makes selling any kratom product to anyone under the age of 21 a second-degree misdemeanor, punishable by a fine of up to $500 and the possibility of up to 60 days in jail.

In December 2023, Florida lawmakers introduced Senate Bill 842, an updated version of the Florida Kratom Consumers Protection Act. SB 842 adds new regulations to the sale and possession of kratom products, namely:

  • Kratom products must not contain adulterated substances
  • The level of 7-hydroxymitragynine cannot be higher than 2%
  • Kratom products cannot contain any synthetic alkaloids
  • Products must have a label that clearly states the recommended serving size along with a list of all ingredients

Governor DeSantis signed Senate Bill 842 into law, which will take effect on July 1, 2024. This is excellent news for kratom enthusiasts. This new law protects the sale of kratom and ensures that nothing can be added to the product, among other safeguards.

FAQs About Kratom

What Is Kratom? Where Does it Come From?

Mitragyna speciosa, better known as kratom, is a tropical evergreen tree native to Southeast Asia in countries such as Maylasia, Indonesia, and Thailand. Traditionally, its leaves were chewed or brewed as tea and indigenous cultures used them as an all-natural way to increase productivity. It was popular with fishermen, farmers, and others of the working class. Now popular in the Western world, kratom is available as a powder, capsule, and even as gummies.

How Is Kratom Made?

The magic of kratom is derived from the leaves of the Mitragyna speciosa tree. Once harvested, they’re either dried in the sun or within modern drying facilities. After a specific amount of moisture has been extracted, the leaves are then ground into a fine powder. This powder is either packaged for sale or used for further processing for extracts, tinctures, and other kratom products.

How Do I Know I’m Purchasing a High-Quality Kratom Product?

When purchasing kratom in a state where the product is unregulated, it could prove to be difficult to know precisely what you’re getting. MIT45 is committed to ensuring all our products are lab-tested and purified three times.

MIT45 is honored to hold the designation of an American Kratom Association Good Manufacturing Practices Qualified Kratom Vendor (AKA GMP Vendor). We approach this responsibility with great care, particularly as one of the founding members of the AKA.

Our accreditation underscores our dedication and adherence to the highest standards of current Good Manufacturing Practices (cGMP). We have complete confidence that our commitment to these practices ensures the safety of our facility, employees, products, and customers.

Which States Have Banned the Sale of Kratom?

Currently, six states in the country have completely banned the sale and possession of kratom. This highlights the importance of kratom advocacy groups who are fighting to keep kratom available for adults and also to ensure that it’s properly regulated. Kratom has been banned in:

  • Alabama
  • Arkansas
  • Indiana
  • Rhode Island
  • Vermont
  • Wisconsin
