The History of Kratom Legality in Oklahoma

Two years before the DEA announced its intention to classify kratom as a scheduled controlled substance in 2016 (they quickly reversed their decision), Oklahoma attempted to do the same. Fortunately for the fans of kratom, Oklahoma House Bill 2666 didn’t pass. If it had, kratom would have been banned statewide.

In 2020, Oklahoma lawmakers introduced House Bill 2846, the state’s first attempt to pass the Kratom Consumer Protection Act (KCPA). This law would officially make kratom legal within the state but also would have regulated some aspects of its sale and possession. Unfortunately, the bill died in committee.

However, the following year, the state succeeded in passing House Bill 1784. Oklahoma joined the growing list of other states that have passed versions of the KCPA to make kratom legal and to regulate and place some safety restrictions on the product. Effective as of 2022, Oklahoma’s KCPA has main three points:

  • Kratom can only be sold to those 18 years of age or older.
  • Products cannot contain synthetic substances.
  • Potentially dangerous substances cannot be added to kratom products.

The Legality of Kratom in Oklahoma in 2024

In 2024, Oklahoma lawmakers felt a need to amend the KCPA with House Bill 3574. Passed in May 2024, this bill added more restrictions and clarified the differences between kratom leaf products and kratom extracts. The bill’s key points include:

  • Kratom products cannot contain more than 1% of the alkaloid 7-hydroxymitragynine.
  • Forbids the sale of any kratom product with synthetic alkaloids.
  • All kratom products must have a label that has a list of all ingredients.

This updated KCPA goes into effect on November 01, 2024. Oklahoma lawmakers feel that kratom should be available to all adults in the state. However, they’ve added more restrictions on the product than other states with similar KCPA on their lawbooks. Oklahoma lawmakers have proven that not only do they feel that kratom should be available in the state but also that certain safeguards must be in place.
