Kratom Legality in North Dakota

With its uniquely diverse landscapes and low population density, North Dakota is truly a place where you can let go, relax, and do your own thing without many people getting in the way. While the state typically holds conservative values, its residents tend to mind their own business. This attitude of smaller government has been a blessing for fans of kratom. When you ask, “Is kratom legal in North Dakota,” you can probably guess the answer.

Yes. Kratom is legal in North Dakota. It is legal to sell, possess, and use kratom anywhere within the state.

Kratom Laws in North Dakota

Current Status of Kratom Laws in North Dakota

There is no current talk of legislation that will ban kratom outright or regulate it in any way, shape, or form. North Dakota residents and lawmakers have never debated the product, unlike other states that have either banned it or placed restrictions and regulations on this product derived from the leaves of a tree native to Southeast Asia.

National Kratom Legislation

In 2016, the DEA announced that it intended to place kratom on the list of Schedule I Controlled Substances. This action would have made kratom illegal in all fifty states. However, due to public outcry and pressure from advocacy groups like the American Kratom Association, the DEA quickly withdrew its intent, leaving the choice of the legality of kratom to each state.

Some states have enacted the Kratom Consumer Protection Act (KCPA), a law that protects kratom while placing restrictions and requirements on its manufacturing, but North Dakota isn’t one of them.

In October 2023, Senator Mike Lee (R-UT) introduced the Federal Kratom Consumer Protection Act. This bill aims to establish strict federal guidelines for kratom, such as a minimum purchasing age and labeling requirements, and to regulate its manufacturing and processing. However, the bill has not progressed and is considered dead in committee.

Where to Buy Kratom in North Dakota

Purchasing kratom from brick-and-mortar establishments in North Dakota may be limited to those who live in more populated areas. You may want to try in smoke and vape shops as many of them do have some kratom products available. However, it’s advisable to call ahead first and inquire about the availability of kratom products that they carry in-house.

You can also try to find it at some convenience stores, especially those that cater to herbal products. Again, to save yourself from a wasted trip, call ahead and see if they sell kratom products.

In a state like North Dakota, with lots of wide open spaces between cities and towns, your best bet may be to order your kratom products online. Most online retailers offer fast delivery, and some offer significant discounts if you order in bulk. By doing so, you’ll never go without your favorite kratom products and never have to travel to purchase them.

Tips for Buying Kratom

While one of the benefits of buying kratom in an unregulated state is the availability of the product with no restrictions, it does come with a caveat. With no state regulations to monitor the kratom market, unscrupulous vendors can sell adulterated products. With no safeguards in place, it’s crucial that you do your research before picking a product.

This is where online buying has an advantage. Any reputable online kratom retailer will be completely transparent about the products they sell. Fly-by-night kratom vendors operating in unregulated markets may replace pure kratom powders and extracts with synthetic alkaloids, many of which may not exactly be what you want to put in your body.

As an ethical kratom vendor, MIT45 is committed to providing the best products that have been lab-tested for identification and to ensure they don’t contain any heavy metals, microbes, or other contaminants. We are an American Kratom Association-certified vendor, so you can be sure you’re getting the best kratom from a trustworthy company.

Kratom, Employers, and Drug Testing

Kratom, when used responsibly, shouldn’t cause any concerns for your employer or prospective employer. However, many responsible fans of kratom are concerned about how their employers may feel if they discover that they enjoy the benefits of this product. It may not be much of an issue in a state like North Dakota, where everyone is free to pursue their own pleasures, but some people may not understand what kratom is and is not.

“Does kratom show up in a drug test,” is a common question for those who are new to the kratom world, and it’s a fair one to ask. The answer is yes, kratom can show up in a drug test, but not any of the ones that are common for employers or even law enforcement to use. Most will order a five- or ten-panel screen to detect the most commonly used illegal substances. Even in a state where kratom has been banned, it’s highly unlikely for anyone to order a test that detects kratom.

So, with that being said, kratom can be detected, but only if a test is performed that specifically tests for kratom, or rather for the presence of kratom’s two main alkaloids, mitragynine and 7-hydroxymitragynine.
