However, in January 2020, the legality of kratom in Maryland was under attack. State lawmakers challenged the sale of kratom by filing Senate Bill 147. Very similar to the DEA’s intentions in 2016, this bill would have categorized kratom as a Schedule I controlled substance within the state and would have made its sale or possession a crime. Again, thanks to advocacy groups and concerned citizens, Senate Bill 147 did not pass.
In early 2024, Maryland lawmakers introduced House Bill 1229, also known as the Kratom Consumer Protection Act. Fortunately, it passed and has been signed into law. This bill is terrific news for the residents of Maryland as it helps to eliminate a statewide ban on kratom products while also ensuring that it’s properly regulated. Some of its highlights include:
- Requiring that kratom products be properly labeled
- Purchasers must be 21 years of age or older
- All kratom products must be unadulterated and not contain any synthetic alkaloids or illegal substances
The Kratom Consumer Protection Act is a win for kratom users in the state, as it keeps it legal and safe. The American Kratom Association strongly supports consumer protections while advocating for its availability to adults who enjoy the benefits of kratom.
