Current Status of Minnesota Kratom Laws
Many states have attempted to ban kratom, and a small number have been successful. The American Kratom Association has lobbied to protect kratom consumers from these bans so that they continue to have access to this helpful botanical.
However, Minnesota took a different approach when it legalized kratom in 2018. This was only after the Minnesota Board of Pharmacy advocated for scheduling kratom in 2017.
For the past few legislative sessions, Minnesota representatives have proposed a Kratom Consumer Protection Act. This legislation would go beyond legalizing kratom and place limitations on what can and can’t be sold as a kratom product.
There are currently no other laws being proposed regarding kratom. From our perspective, the sale and possession of kratom is settled law for the time being.
Current Regulatory Status of Kratom in Minnesota
Kratom industry leaders support the idea of regulating kratom. Why? Because it would create a safer, more consistent kratom experience for kratom consumers.
The FDA doesn’t regulate kratom at this time, although the American Kratom Association supports and advocates for strong regulations in conjunction with the full legality of kratom nationwide.
If the Kratom Consumer Protection Act is passed in Minneapolis this year or in some future legislative session, kratom vendors will not be permitted to sell:
- Kratom that has been adulterated with a dangerous non-kratom substance
- Contaminated kratom product
- Kratom that contains certain levels of residual solvents
- Kratom that contains more than 2% of 7-hydroxymitragynine alkaloid content
- Any kratom product containing synthetic alkaloids
- Inadequately labeled kratom products, including kratom without a recommended serving size

It’s a little surprising just how much information you can find by visiting Minnesota’s health and government websites.
When we searched for kratom on the Minnesota Department of Health’s website, we found a press release about a salmonella outbreak associated with kratom, back in 2018. A little more digging reveals that this outbreak was isolated and resolved, and there have been no additional salmonella outbreaks associated with kratom.

Because there is still the possibility of a Kratom Consumer Protection Act in Minnesota, you can contact your state representative to express your support for kratom and its uses.
