Kratom Legality in Nevada

Learn About the State Laws and Regulations that Impact Users

From the nightlife in Las Vegas to the natural beauty of Lake Tahoe, adventurers and tourists alike take a gamble on a memorable experience in Nevada. The state attracts people who long for a fulfilling, fun life. But where does Nevada stand on kratom laws and regulations?

Is kratom legal in Nevada in 2024? Enthusiasts will be relieved to learn that the short answer is yes. However, there are kratom regulations in the Battle Born state, and future legislation could impact fans of the botanical.

The guardrails that are in place in Nevada can help protect kratom users from unsafe products and allow the guaranteed safe, high quality, and pure MIT45 kratom products to be sold legally.

MIT45 is happy to serve as your expert guide through an in-depth look at kratom’s legal status in Nevada in 2024.

Current Status of Nevada Kratom Laws

The legal status of kratom has been a point of hot debate among state legislators for years. In recent years, bills introduced to the state Assembly (House of Representatives) and state Senate, including AB322, have attempted to ban kratom or place heavier regulations on the distribution, sale, and purchase of the botanical.

Nevertheless, none of these bills have passed both chambers of Congress nor have been passed into law. Kratom advocacy groups, such as the American Kratom Association, continue to raise public awareness and education to promote access to safe products and to push to keep further bans out of states considering them.

Current Regulatory Status of Kratom in Nevada

Nevada is one of several states, including Arizona, Georgia, and Utah, to pass a version of the Kratom Consumer Protection Act (KCPA). Introduced in 2019, this law regulates the advertising, distribution, sale, and purchase of kratom in hopes to set industry standards and make the botanical products safer for enthusiasts.

The KCPA places regulations in the hands of the Nevada State Board of Pharmacy and mandates the following:

  • All kratom products must include transparent labeling
  • Kratom purchasers must be over the age of 18 with valid ID
  • It’s unlawful for anyone to knowingly sell or offer kratom to a minor
  • No sold or offered kratom products can be adulterated with a substance that impacts the strength or quality of the kratom
  • Any individual who does not follow these requirements will be subject to a fine of no more than $1,000 and a civil penalty of no more than $1,000

The state’s KCPA aims to make kratom products safer for kratom users from all walks of life.

Search state government websites

It’s surprising how much information about kratom you can find on state government websites. This information may not appear in your general search engine results, so it’s a good idea to visit these sites directly.

We’ve found that simply typing “kratom” into the search bar of the Nevada Department of Health and Human Services will yield immediate results.  For instance, a link to this government file about Governor Joe Lombardo’s veto of the proposed kratom ban, AB322, came up as the first result in our quick search.

If you have questions that the Board of Pharmacy can’t answer, you can also find basic information about kratom on these websites.

Contact your state representatives

Although there isn’t any pending kratom legislation under review in 2024, the laws and regulations are always subject to change. If you’d like to advocate for safe but legal kratom use, you can contact your state representatives. Most state representatives like to hear from their constituents and will have someone from their office return messages.

In Nevada, kratom products can be found in both online vendors and local physical stores.

Where to Legally Buy Kratom in Nevada

Currently in Nevada, you can purchase kratom products from online vendors or any physical location where it’s sold (including kava bars, smoke shops, and convenience stores).

However, it’s important to purchase from known, reputable vendors and look at the labeling in any physical stores that carry kratom products.

All products are required to include clear labeling per the Nevada Kratom Consumer Protection Act. Nevertheless, online kratom vendors may be the best option as reputable brands have online stores with numerous product options.

Tips for Buying Kratom in Nevada and Verifying Product Quality

MIT45 highly recommends purchasing kratom online, as it’s easier to vet online vendors. This enables kratom users to ensure the product they’re looking for is in stock, too. Physical stores may be hit or miss when it comes to kratom supply, so it’s a good idea to call ahead before traveling to make a purchase.

When shopping for kratom online, start by looking for an AKA vendor certification  and a verifiable Certificate of Analysis. These credentials can help establish that brands adhere to a high level of quality and safety in their manufacturing practices.

Shopping online also allows research of individual kratom products. By looking at the product description and ingredients, it’s easier to make an informed selection. When purchasing kratom products in a physical location, the employees of a store may not be knowledgeable about individual products or kratom in general.

Shopping online also enables kratom enthusiasts to:

  • Ensure they’re purchasing from a vendor they trust
  • Discover more about the variety of available kratom products
  • Get deals on prices and shipping costs
  • Buy from a brand with expertise and dedication to kratom
  • Learn more detailed information about specific products

Drug testing, work culture, and employment policies

For people on a kratom journey in Nevada, it’s important to be able to enjoy the potential benefits of kratom without having to worry about how it may impact their employment. Although kratom is legal, can there be professional consequences for taking it?

Although we can’t speak for every employer, kratom should not have any impact on work life in Nevada. Kratom detection isn’t included in the results of a standard drug panel, but in theory, it can be detected. However, an employer would have to specifically ask for kratom detection to be included in a drug test panel.

In rare instances, kratom has caused a false positive for opiates, so it’s important to be aware of this possibility. Similarly, if kratom use adversely affects work productivity or behavior, then a kratom user could still face professional consequences. Nevertheless, disclosure of kratom use is voluntary in most workplaces.

Social Values and Personal Liberty

People from all backgrounds enjoy kratom for many different reasons. Many MIT45 customers use kratom in their pre-workout routines for its potentially energizing benefits. Kratom is similar to coffee in the natural way it supports increasing your energy levels and may enhance your mood and productivity.

We believe that every individual should have the personal liberty to choose to take kratom and to trust in the safety and quality of the products they purchase.
