The History of the Legality of Kratom in Nebraska

The DEA announced its intention to add kratom to the list of Schedule I Controlled Substances. Due to public outcry and pressure from kratom advocacy groups like the American Kratom Association, the DEA quickly withdrew its intention. If they had moved forward, a nationwide ban would have been placed on this botanical.
Also in 2016, Kansas lawmakers introduced LB 293, a bill with the same intentions as the DEA, to forbid the sale and possession of kratom, however, on a statewide level. Like the DEA’s troubles, the bill stalled and did not pass.
Again, in 2019, the debate about the legality of kratom in Nebraska raised the eyebrows of its state’s lawmakers. However, this time, legislators proposed the Kratom Consumer Protection Act (KCPA), a bill that would place restrictions on the sale of kratom products. A handful of states have passed their own version of the KCPA. Its key points include:
- Age restriction: Prohibits the sale of kratom products to minors.
- Labeling requirements: All kratom products must have labels listing all ingredients, alkaloid percentages, and suggested serving sizes.
- Banning contaminates: Kratom products are prohibited from containing adulterates or synthetic alkaloids.
- Quality assurance: Kratom products must be lab-tested to ensure safety.
The KCPA keeps kratom legal within a state while placing certain restrictions and regulations on its sale, which is a win for kratom enthusiasts and advocacy groups. Unfortunately, the bill did not pass.
The Legality of Kratom in Nebraska 2024
Currently, kratom in Nebraska is legal to sell, possess, and enjoy. The product remains completely unregulated. While advocacy groups want kratom to remain available, they do support some regulations and are in favor of the Kratom Consumer Protection Act.
Unfortunately, a new battle has risen to the surface concerning kratom. In January 2024, Kansas legislators introduced LB 972, a bill to add kratom to Nebraska’s list of controlled substances. Fortunately for the fans of kratom in Nebraska, as of April 2024, it’s been indefinitely postponed. LB 972 doesn’t appear to have become law, but the fact remains that kratom legality within Nebraska is under attack.

Nebraska, Kratom, and Employment Drug Testing
This is a very common concern among some kratom enthusiasts. While each individual’s experiences and situations differ, here’s what we know.
Nebraska is an at-will state, meaning that you or your employer can legally end the employment relationship at any time and for any reason. While job terminations directly related to kratom are rare (if there are any at all), theoretically, it could happen.
While kratom could show up in a drug test, the lab would have to test for kratom specifically. And even if your employer requested this type of testing, since Nebraska is an at-will state, they wouldn’t be required by law to disclose this information.
Kratom is legal in the state, so it would be a rare instance for an employer to test for kratom.
