Kratom Legislation in North Carolina
North Carolina’s legislative relationship with kratom began in 2015 when the state’s lawmakers proposed Senate Bill 830. The bill sought to add kratom, more specifically, its two main alkaloids, mitragynine and 7-hydroxymitragynine, to the state’s list of controlled substances. The primary goal of this bill was to ban the product in the state. Fortunately, for fans of kratom, the bill was hit with a backlash from kratom advocacy groups like the American Kratom Association, and it failed to pass.
In 2016, North Carolina passed House Bill 747, which implemented an age restriction on the sales of kratom. Only those 18 years of age or older can legally purchase the product in the state. While this age restriction is a step in the right direction to protect the product’s legality, it doesn’t come with the other restrictions that states that have passed the Kratom Consumer Protection Act (KCPA).
More than a dozen states have passed the KCPA, an act that keeps kratom legal but also enforces some restrictions and regulations on the sale of the product. Kratom advocacy groups like the American Kratom Association want the product to remain legal and available to all adults but with the following restrictions and requirements:
- Age restrictions: The sale and possession of kratom should be limited to individuals either over 18 or 21 years of age.
- Product labeling: Kratom products must contain labels that list all ingredients, a recommended serving size, and the amount of active alkaloids.
- Purity standards: Kratom products that have been adulterated with synthetic alkaloids or other substances are prohibited.
- Required lab-testing: All kratom products must be lab-tested to ensure they are free from contaminants.
While North Carolina has so far only enforced an age restriction on kratom, the state’s lawmakers are considering introducing the KCPA, which would further enhance the safety of kratom in the state.
