Current Status of Oregon Kratom Laws
Kratom has never been seriously challenged in Oregon, although kratom would have been made illegal in the state if a federal ban had gone into effect in 2017. Fortunately for kratom advocates, the DEA reversed its initial plans to outlaw kratom that year.
In 2021, Oregon legislators passed the first KCPA, but Governor Kate Brown vetoed it because of concerns regarding the state having to manage additional regulatory functions. However, the 2022 version of the bill (HB 4010) was signed into law in March of 2022 and went into effect in July of 2023.
Current Regulatory Status of Kratom in Oregon
The goals of the Kratom Consumer Protection Act are two-fold. The first goal is to make sure that kratom users don’t have to worry about their favorite products being banned by the state. The second goal is to protect kratom users from unscrupulous vendors who would sell low-quality and even dangerous kratom products.
The law specifies:
- Age restriction: Retailers are prohibited from selling kratom products to individuals under 21 years of age. Violating this is classified as a Class C misdemeanor.
- Processor registration: Kratom processors must register annually with the Department of Revenue before selling, distributing, or exposing kratom products for sale. Failure to do so can result in civil penalties.
- Third-party testing: Processors must certify that all their kratom products are third-party tested to meet industry standards for adulteration.
- Department of Revenue oversight: The Department of Revenue is tasked with adopting rules for implementation, including registration procedures and fee collection. The collected fees are meant to cover the cost of administering and enforcing the Act.
- Effective dates: While the Act was approved in March 2022, its main provisions become operative on July 1, 2023, giving time for preparation and implementation.

Drug testing, employment practices, and work culture
