Is Kratom Legal in Michigan?

A Comprehensive Guide by MIT45

Kratom remains unregulated at the federal level. Currently, in the state of Michigan, the sale, production, purchase, and use of kratom is perfectly legal.

However, a significant development occurred in April 2023 with the introduction of House Bill 4061, known as the Kratom Consumer Protection & Regulation Act.

What’s Next for Kratom Regulation in Michigan

Eleven states have already implemented the Kratom Consumer Protection Act (KCPA). If Michigan joins their ranks, it aims to establish one of the most comprehensive regulatory frameworks in the country.

Similar to other states, Michigan state Rep. Lori Stone’s proposed bill includes age and labeling requirements, defines kratom as a food product, and prohibits the sale of adulterated kratom products.

However, Michigan’s proposed law goes further by introducing a licensing system for kratom sellers and leveraging the state’s regulatory infrastructure for oversight. Additionally, it outlines a rigorous kratom lab-testing program and explicitly addresses online kratom sales.

Expressing the necessity for regulation, Stone emphasized the lack of adequate labeling, serving size information, and warnings about kratom’s effects in Michigan. She stressed the urgency of enacting laws to ensure consumer safety and transparency in the kratom market.

Emphasis on Quality and Transparency

Why do we at MIT45 care so much about better kratom regulation? Because better regulation means more transparency and better quality across the entire industry.

We are opposed to legislation banning kratom in Michigan, but good legislation would include consumer protections that improve quality and transparency. This could mean:

  • Clear and accurate labeling on all kratom products
  • Requiring ingredient lists on packaging
  • Accurate labeling of alkaloid percentages
  • Cautionary health statements for those at high risk of complications
